  1. INTRODUCTION


    1. Renown (hereinafter referred to as “We” or “Us” or “Our”) respects the privacy of our Users (“User” or “You”). This Privacy Policy explains how We collect, use, disclose, and safeguard Your information when You visit Our website (www.renownapp.com) and Our mobile application (“Renown App”), both shall be collectively called as “Platform” in this Privacy Policy, and shall include any other form, channel, website, or mobile application related or connected thereto. Please read this Privacy Policy carefully. If You do not agree with the term laid down in this Privacy Policy, please do not access the Our Platform.

    2. We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert You about any changes by updating the effective date of this Privacy Policy. You shall be notified regarding any changes to this policy seven (7) days prior, through the message displayed on the Platform. Once the changes and/or modifications are live on the Platform, it shall be effective immediately.

    3. This Privacy Policy is a part of our ‘Terms of Usepolicy. This Privacy Policy describes how we collect, process, use, retain, and share data.


  2. INTERPRETATION AND DEFINITIONS


    The terms and phrases which have been capitalized and used within this Privacy Policy have meanings defined below. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural form. The definitions of the terms used within this Privacy Policy are elaborated below:

    1. ‘Account’: means a unique account created by You to access or provide Services or parts of Your Services via Renown.

    2. ‘Child’: means any person below the age of eighteen years.


    3. ‘Consent’: shall refer to the explicit, free and unambiguous consent of the Users on the Platform, and shall have the same meaning as defined under the DPDPA.

    4. ‘Content’: refers to the Content created by a Creator on the Platform with or including ‘Renown Features’.

    5. ‘Compatible/Supported Device’: means a personal computer, mobile phone, portable media player, or other electronic device that meets the system and compatibility requirements and on which You are authorized to operate the Platform.

    6. ‘Cookies’: are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many Uses.

    7. ‘Creator/Artists’: refers to the individuals, group, or legal entity on behalf of which such individual is accessing or Using Our Platform to create, promote and sell Services or products.

    8. ‘Data Fiduciary’: refers to Renown as the legal entity, for the purposes of the DPDPA, who alone or jointly with others determines the purposes and means of the processing of Personal Data.

    9. ‘Data Principal’: refers collectively to the Users. They have the same rights as provided under the DPDPA.

    10. ‘’‘Data Protection Officer’: refers to the officer appointed by Renown in compliance with the provisions of DPDPA (hereinafter referred to as ‘DPO’).

    11. ‘Digital Persons Data Protection Act of 2023’: refers to the legislation effective for September 2023, and aimed at safeguarding the privacy of individuals in India (hereinafter referred to as ‘DPDPA’).

    12. ‘Grievance Officer’: refers to the officer appointed by Renown for redressal of complaints and User grievances.

    13. ‘Personal Data/Information’: is any data or information that relates to an identified or identifiable individual, i.e., Personally Identifiable Information (PII). For the purposes of the DPDP Act, Personal Data means

    14. ‘Platform’/ ‘Website’: refers to Renown, accessible at . It can be accessed on devices such as a computer, a mobile phone or a digital tablet.

    15. ‘Privacy Policy’: refers to this Policy. This Privacy Policy is intended to comply with the requirements of the DPDPA. We are committed to protecting the privacy of our Users and complying with all applicable data protection laws.

    16. ‘Renown Features’: Renown Platform is a web-based service that provides an online Platform to create, design, publish and sell digital services such as content subscriptions, live events, and 1-1 interactions.

    17. ‘Service Provider’: refers to the Creator on the Platform.


    18. ‘Service’: refers to the physical or digital products or services accessed, availed, or purchased by a User.

    19. ‘Social Media Intermediary’: means an intermediary which primarily or solely enables online interaction between two or more Users and allows them to create, upload, share, disseminate, modify or access information Using its services.

    20. ‘Subscriber’: refers to end Users who can be an individual, group, or legal entity on behalf of which such individual is accessing or using Our Platform.

    21. ‘We’/ ‘Us’/ ‘Our’: refers to Renown, a company incorporated in India.


    22. ‘You’/ ‘Your’/ ‘User’: refers collectively to the Creators and the Subscribers. It can be an individual, group, or legal entity on behalf of which such individual is accessing or Using Our Platform.

      For this Privacy Policy, the term ‘Personal Data/Information’ also encompasses within its ambit the meaning and terms ‘Sensitive Data/Information’ and ‘Personal Information’ as envisaged in Rule 2(2)(i) and 3 of the SPDI Rules of 2011. The meaning and scope of the definitions are subject to change per any change / modification / repealing and / or amendment to any legislation(s) or rule(s) pertaining to the same.


  3. USE OF PERSONAL DATA

      7. To market Renown to You;


      8. To understand how you use the Service / Platform and create better tools for Creators to serve Subscribers;

      9. To conduct research and development to improve Renown and develop future products;

      10. To prevent fraud and abuse on Renown;


      11. To ship merchandise to You if a benefit includes it;


      12. To allow Us to provide You with reasonable accommodation if You notify Us of a disability;

      13. To perform other business activities; and


      14. To resolve disputes and troubleshoot problems within the Platform or software,


    2. For the aforementioned purposes of processing Your information, You shall be required to provide Your explicit consent while registering on the Platform.


  4. CONSENT


    1. We are committed to protecting Your privacy in complete legal compliance with the Digital Persons Data Protection Act of 2023 (DPDPA). You have the right to access, erase, withdraw consent, nominate, and restrict the processing of Your Personal Data under the DPDPA.

    2. The Consent obtained from Users is in compliance with the DPDPA. The Consent provided by You is freely given, informed, unambiguous, and specific. Your continued use of this Platform constitutes Your explicit Consent to the collection, usage, storage, sharing and disclosure of Your Personal Data.

    3. We may share or disclose Your Personal Data and any other relevant information for any other purpose not listed within this Privacy Policy, by notifying You concerning the same and only after Your explicit consent to do so.

    4. You can withdraw Your Consent at any time by:


      1. Deletion of Your profile and account on Our Platform


      2. Opting out of communications by emailing the grievance officer or DPO (refer to the details mentioned at the end of this Privacy Policy);

      3. Contacting Us at support@renownapp.com to request data modification or erasure.


    5. The Users are informed that withdrawal of Consent may limit Your ability to use or interact with certain Platform features.

    6. We may update this Consent Clause from time to time. In case of any queries related to this particular clause, please get in touch with our DPO.


  5. RETENTION OF PERSONAL DATA


    1. We retain the Personal Data of Our Users for a period of 6 (six) months in both the instances of deletion account or the deactivation of account by the account holder on Our Platform. Furthermore, the retention of the Personal Data is subject to circumstances that may vary on a case-to-case basis.

    2. Renown will retain Your Personal Data only for as long as is necessary for the purposes mentioned within this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with the legal obligations required by the applicable laws, to resolve disputes or complaints, and to enforce legally binding agreements and policies.

    We collect and use Personal Data from Our Users to provide or suggest services according to their preferences.

    1. Personal Data for Opening an Account


      1. Personal Data: This is information You provide Us through text fields, payment information and benefits. Any data that can be associated, linked, related to, or identifies a particular person, group or legal entity, directly or indirectly would be considered to be Personal Data.

      2. The information we collect differs depending on whether you make an account, become a subscriber, or become a creator. While opening an account on our Platform, you will have to consent to mandatorily provide the following information to Us:

    2. Financial/Transactional Data


      1. To receive payouts, you have to provide Us with your preferred payment mode with your details e.g. UPI / Bank Transfer etc. You must also provide Us with additional information for tax purposes.

        3. PAN Card (not mandatory for the Subscribers)


        4. Aadhar Card (not mandatory for the Subscribers)


          Note: The information regarding PAN Card and Aadhar Card are to be mandatorily provided by the Creators.


    3. Content Data


      1. We collect data regarding the content uploaded by the Creators with which the Subscribers or general Users might interact, including the text, images, videos, comments, and any other content and related interaction with it. This collection of data is for the purpose of internal analysis of Our Platform’s growth and regulation.


        Additional Data We Collect


    4. We collect, use, and store information from the User interaction with and on Our Platform, such as services browsed, email addresses, comments, and relevant profile information. We collect and store information if You interact with a Creator’s educational service website.

    5. We collect information automatically as you navigate the website or through our third-party analytics providers. We may store usage information such as:

      1. The type of device You use to access Renown;


      2. Your operating system, browser type;


      3. IP Address associated with Your device, and device ID;


      4. The pages You visit or request to view;


      5. Links clicked;


      6. Referring to sites;


      7. User interactions;


      8. Your search terms and keywords;


      9. Your geo-location from Your self-disclosed country and Your IP Address.

    6. We as a Platform use Cookies and web beacons as tracking technologies to track the activity on Our Platform and store certain information. Tracking technologies are used to collect information, and to improve and analyse Our Platform. Here is a brief description of them:

  7. TRANSFER OF PERSONAL DATA


    1. Your information, including Personal Data, is transferred to and stored on our cloud database server in Mumbai, India.

  8. SHARING OF YOUR PERSONAL DATA


    1. We will share Your Personal Data with the following in certain circumstances as elaborated upon in the below-mentioned clauses:

      1. If a Subscriber avails the subscription or enrolment of a Creator, You Consent to the following information being shared with the Creator –

        1. Basic Information: Your name.


        2. Profile Information: Your profile information is available on the Platform.


        3. Payment Information: Your shipping address, physical location, and country in case You avail of a digital benefit / product.

        4. Messages You Send: The contents of any messages You send to a Creator through Renown will be shared with the recipient.

        5. Certain aggregated and anonymised data about how you use Renown cannot be linked back to you or to any individual User.


    3. With Subscribers and Other Users


      1. Users who have subscribed to a Creator account or purchased a product or a User simply engaged with the Creator’s Content on the Platform, Consent to the sharing of the following Personal Data:

        1. Your Full Name


        2. Your Profile Picture


        3. The content You view, etc.


    4. Third-Party Service Providers


      1. We may share Your information with third parties that perform services for Us or on Our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance.

      2. We may also share your information with such third parties for marketing purposes, as permitted under the existing law in India.

  9. DISCLOSURE OF YOUR PERSONAL DATA


    1. We may share or disclose Your information that We have collected in certain situations or context(s). Your information may be disclosed in the following circumstances:

  10. SECURITY OF YOUR PERSONAL DATA

While we have taken reasonable steps to secure the personal information you provide to Us, please be aware that despite our best efforts, no security measure is perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties.

    2. Therefore, we cannot guarantee complete security if You provide Personal Data. However, we strive to use commercially acceptable means to protect Your Personal Data.

    3. Notwithstanding anything to the contrary, in the event that any Personal Data entrusted to Renown is compromised as a result of a breach of Renown’s security measures, despite

      Renown’s reasonable efforts to prevent such occurrences, User agrees to indemnify, defend, and hold Us harmless from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees and court costs) arising from or related to such compromise or breach of privacy. Under no circumstances shall We be liable for any such compromise or breach of privacy under this Privacy Policy or otherwise.

    4. Storage of Personal Data


      1. The information collected by Us is securely stored on Our website within Our controlled database located in Mumbai, India.

The Personal Data and other information collected by Us may be Used in the anonymized form for internal reviews, surveys and Data Protection Impact Assessments (DPIA) as permitted under the DPDPA. We will ensure that the any anonymized data maintained (due to any exceptional circumstance or otherwise) is only used for this purpose, and is not identifiable to any specific individual.

        1. Identify and Mitigate Potential Privacy Risks: By analysing anonymized usage data, We can identify areas where our data practices might pose a privacy risk. This helps Us proactively address these risks and improve your overall privacy protection.

        2. Enhance the Platform and Security: We may use anonymized data to understand User behaviour and preferences. This allows Us to improve the Platform’s functionality, User experience, and security features.

  11. PROCESSING OF YOUR PERSONAL DATA

    2. Legitimate Reasons for Processing Your Personal Data under DPDPA

      1. We process data in compliance with the DPDPA provisions. All the reasons mentioned within this Privacy Policy constitute a lawful purpose.

      2. We endeavour to only process the data for which the Data Principals have given their Consent.

    5. Payment Services


      1. We and/or Creators on Our Platform may provide paid services or products. To avail of such services or products, You might have to use financial information. In that case, We may use third-party services for payment processing.

      2. We will not collect or store Your financial information. That information is provided directly to Our third-party payment processors whose use of Your Personal Data is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS. PCI-DSS requirements help ensure the secure and safe handling of the financial information used for payments.


  12. YOUR RIGHTS UNDER DPDP A, 2023


    1. The Creators /Artists, Subscribers and other Users of Renown as a Platform are guaranteed to exercise Your rights as Data Principals. As Data Principals, You have guaranteed rights under the DPDPA.

    2. The Renown Platform undertakes to respect the confidentiality of Your Personal Data. Under this Privacy Policy, and by law if You are within the domicile of India, to:

      1. Access to Your Personal Data: You have the right to access, update or delete the information We have on You. Whenever made possible, you can access, update or

        request the deletion of Your Personal Data directly within Your account settings section. If you are unable to perform these actions yourself, please contact Us to assist You.

      2. Request Correction of the Personal Data: You have the right to have any incomplete or inaccurate information We hold about You corrected.

      3. Request Erasure of Personal Data: You have the right to ask Us to delete or remove Personal Data when there is no good reason for Us to continue processing it.

      4. Right to Nominate: You have the right to nominate any individual who is, (a) known to You; (b) is above the age of 18 years; or (c) is not a serious criminal offender. This nominated individual shall act as Your Legal Guardian and shall officially be handed over any and all of Your Personal Data available on the Platform in case, (a) of Your death; or (b) You are permanently disabled.

      5. Right to Withdraw Consent: You have the right to withdraw Your consent to using your Personal Data. If You withdraw / modify Your consent, We may not be able to provide You with access to certain specific functionalities of the Service(s) on Our Platform.

Object to processing of Personal Data: This right exists where We are relying on a legitimate reason as the legal basis for Our processing and there is something about Your particular situation, which makes You want to object to our processing of Your Personal Data on this ground. You also have the right to object where We are processing Your Personal Data for direct marketing purposes.


    4. Exercising the said rights

You may exercise Your rights of access, to be informed, rectification, cancellation, erasure or deletion, objection, consent withdrawal, and opposition to automated decisions and profiling by reaching out to Us.We also take steps to ensure that the Personal Data we collect is accurate, complete, and up to date. We ensure that the data or information if deemed to serve no further purpose and is no longer required will be completely deleted.

      2. Your rights are subject to defined conditions and feasibility to exercise such rights and are subject to territorial applicability.

      3. You have a right to complain in the case that You find your rights being violated or You have a query regarding Your rights. Please note that we may ask You to verify Your identity before responding and proceeding further with Your request.

      4. You have the right to complain to the Data Protection Board of India about Our collection and Use of Your Personal Data. For more information, please contact the Data Protection Board India appointed Consent Manager.

  13. APPLICABLE LAWS AND GOVERNING JURISDICTION


    1. This Policy shall be governed by the laws applicable in the territory of the Republic of India.


    2. The laws specifically applicable to this policy but not limited to include, the Information Technology Act, 2000, The Digital Persons Data Protection Act, 2023, the Consumer Protection Act, 2019, and all the Criminal Laws and their subsequent amendments, rules, gazetted notifications, schedules and annexures, etc., and any other laws within India that may be applicable due to varying circumstances.

    3. In the event of any dispute, the jurisdiction of the courts shall be at Bengaluru, Karnataka (India). We shall endeavour to resolve any issue, claim, concern or dispute related to this Policy in an amicable and informal negotiation(s). If no favourable resolution is reached, it shall proceed to formal court proceedings.


  14. CHILDREN’S PRIVACY


    Disclaimer: No Child, i.e., any individual under the age of 18 years, shall be registered as a User or be entertained in any manner on Our Platform.

    1. Our Platform does not allow, address, solicit, entertain or market to anyone under the age of 18 years to access or use any Services provided by the Users of our Platform. We ensure that we do not knowingly collect any Personal Data belonging to children.

    2. If you are a parent or lawful guardian and You are aware that Your child under the age of 13 years has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 years without supervision, verification or consent of the parents or lawful guardians, We will take the necessary steps to remove that data or information from Our Platform and servers.

    3. Children within the age category of – above 13 years but below 18 years – cannot become a User, Creator or Subscriber on our Platform. It is the parents or lawful guardians responsibility to supervise children within this age category, and any accidental or under false impression by any Child if We permit collection, usage, storage, retention, disclosure, and sharing of Personal Data of such a Child, then We shall immediately remove the said data.


  15. CHANGES TO THIS PRIVACY POLICY


    1. We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page. We will let You know via email and/or a prominent notice on Our Platform, prior to the change becoming effective and update the “Last updated” date at the top of this Privacy Policy.
